| Topic: Bad Checks Question: How long do I have to wait for a bad check writer to reimburse me before I can come to the prosecutor's office for help? ANSWER: A "statutory notice" must be sent to the check writer allowing 5 days to make check good. Checks must be submitted to the program within 60 days from the date on the check, so don't wait too long once you know that the check is bad. |
| Topic: Witnesses Question: I just received a subpoena. Do I need to appear? ANSWER: Yes. A subpoena is a court order requiring you to appear in court on the specified time and date, and on any date to which the case may be adjourned. Failure to appear can result in the issuance of a bench warrant for your arrest. In criminal cases, the testimony of live witnesses is required. Submission of an affidavit or a deposition is not allowed. |
| Topic: Witnesses Question: How will I know if the case is going or is being adjourned? ANSWER: After 5:00 p.m. the night before you are scheduled to appear, call (517) 546-1882. There will be a recording which will instruct you whether or not the case is going, and if there are any changes or special instructions. If the case is not on the recording, you do not need to appear at that time. You may, however, be subpoenaed again for another time and date. |
| Topic: Witnesses Question: Will I get paid for appearing as a witness? ANSWER: Currently, compensation for witnesses is established by State law. You will be paid $6 per half day plus round trip mileage at a rate of 10 cents per mile. When you appear in court, bring your subpoena and write your round trip mileage on it. Give the subpoena to the prosecutor handling your case. It will take approximately 4-6 weeks for your fee to be processed. |
